Gifting Terms and Conditions

Last updated November 3, 2026

1. Who we are and when these terms apply

These Gifting Terms apply to gift purchases and promotional gifts offered through the Simon Sinek website (the “Site”) and sales channels that link to these terms. The Site is provided by Simon Sinek, Inc. and its affiliates, The Optimism Company, LLC, Optimism Productions, LLC, Optimism Training LLC and Optimism Press LLC (collectively “SSI”, “we”, “our” or “us”). The seller responsible for your purchase is the legal entity identified at checkout and in your order confirmation.

These terms cover giftable products and services, including subscriptions and memberships, online courses, digital content, coaching and other services, and any other offering expressly made available for gifting.

They supplement our Terms of Service. Product-specific details disclosed before purchase also apply. For matters concerning gifting, these Gifting Terms take precedence over conflicting general terms. Nothing in any of these terms limits rights that applicable law does not allow us to exclude.

2. Types of gifts

Paid Gifts are products or services purchased for another person.

Promotional Gifts are benefits provided at no additional charge with a qualifying purchase or under another promotion, including “Buy One, Gift One” and “Gift One, Get One”, or given by us at no charge (for example, a prize or a partner gift).

The purchase page will explain what the gift includes, its price, any access period, and any eligibility, location, delivery or scheduling restrictions.

A gift is redeemable only with the seller and through the channels identified at purchase. It is not automatically redeemable with every business, partner or retailer associated with SSI.

3. Purchasing and sending a gift

You must provide accurate purchase and recipient information and be legally able to enter into the purchase contract.

You may choose immediate delivery or a future delivery date where that option is available. After purchase, you choose on your gift page how each gift is delivered: by email straight away or at a date and time you choose, or as a code or printable certificate you pass on yourself. We will send emailed gifts as you arrange them there.

When you provide a recipient’s details, you ask us to use them to deliver and administer the gift. You must be entitled to share those details for that purpose. We remain responsible for our own privacy and electronic-communications obligations.

We handle personal information under our Privacy Policy. Receiving a gift does not automatically enroll the recipient in marketing communications.

If a gift does not arrive, contact us. We will help resolve incorrect addresses, failed emails and other delivery problems. This does not limit any rights concerning late delivery, nondelivery or loss in transit.

4. Recipient eligibility and redemption

Recipients must satisfy any eligibility requirements disclosed before purchase, such as age, location, account requirements or prerequisites for a particular service.

An account and acceptance of the applicable service terms may be required to activate or use a gift. Any material technical requirements, including supported devices, software, functionality and compatibility, will be disclosed before purchase.

Recipients do not need to make an additional purchase to use a fully paid gift or a Promotional Gift, unless an optional upgrade or additional purchase is separately selected.

A subscription gift cannot be redeemed by someone who pays for that subscription through the Apple App Store or Google Play while that subscription is active, because the app store bills and renews it. They can redeem the gift once that subscription has ended. A subscription gift also cannot be redeemed while the recipient’s subscription bought on our website has a payment outstanding, until that payment is settled, or by someone whose access to that subscription does not expire. A course gift cannot be redeemed by someone who already has that course. A gift that cannot be redeemed for one of these reasons may be passed to someone else under section 8. Alternatively, the purchaser may obtain a refund for the unredeemed gift in accordance with section 9. Nothing in these terms limits any cancellation or refund rights available under applicable law.

If a recipient cannot use a gift because of a restriction we did not disclose before purchase, we will offer an appropriate replacement or refund, without limiting other legal remedies.

5. Gift subscriptions, courses and digital products

An unredeemed Paid Gift does not expire. Promotional Gifts follow section 7.

A subscription gift adds its access period (for example, 12 months) to the recipient’s account when they redeem it, and the recipient receives the full advertised period. If the recipient has no current access to that subscription, the period starts when they redeem the gift: for example, a 12-month gift provides 12 consecutive months of access from redemption. If they have access to that subscription that is not paid for (for example, from an earlier gift), the period is added after that access ends. If they pay for that subscription on our website, the period is used at their renewals before anything is charged, and their renewal date does not change. Where the gifted period is shorter than their billing period, it reduces their next renewal by the matching share, and the rest of that renewal is charged as usual. Gifted months not yet used stay on the recipient’s account if their subscription ends, and are used when they next subscribe or redeem a subscription gift.

Any deadline associated with a scheduled course or live program will be disclosed before purchase.

Gift subscriptions do not automatically renew into paid subscriptions. Renewal requires a separate purchase or express agreement to a paid subscription.

Redeeming a gift never makes the recipient a paying subscriber or starts renewal payments, and we never charge the buyer for a renewal. If the recipient already pays for the same subscription on our website, the gift does not change that: the gifted months are used at their renewals as described above, and once the months are used up their subscription renews on the terms they had already agreed to. If they had set that subscription to cancel, redeeming the gift turns renewal back on so the gifted months can be used. We will tell them this before they redeem, and they can cancel again at any time.

Digital products are supplied subject to the permitted-use terms disclosed at purchase. We will provide any updates, support and remedies required by applicable law.

6. Events and appointments

Events and scheduled services. Gifts for a particular event, appointment or program are valid for the date or session identified at purchase. Booking requirements, rescheduling rules and any lawful cancellation restrictions will be disclosed before payment. If we cancel or materially change the offering, we will provide the remedies required by law and any additional remedies promised at purchase.

7. “Buy One, Gift One”, “Gift One, Get One” and other promotions

“Buy One, Gift One” and “Gift One, Get One” offers work the same way, however they are named: with a qualifying purchase, you receive the advertised additional gift at no extra charge, to give to another person. The qualifying purchase, gift, offer period and eligibility conditions will be stated before checkout. The gift issued under either offer can be redeemed for the number of months stated in the offer, and shows its redeem-by date.

Unless the offer expressly states otherwise, purchasing a subscription under either offer provides another person with a subscription of the same duration.

Some offers let someone who already subscribes on our website prepay a period of their plan instead of starting a new subscription. A prepaid period is a one-off payment. It adds that period to their account as gifted months, used at their renewals as described in section 5, and does not change their renewal date or plan. People who subscribe through the Apple App Store or Google Play cannot use an offer to extend that subscription, but can still buy a gift.

The recipient does not need to make a purchase or provide payment details to activate the Promotional Gift.

A Promotional Gift can be redeemed until the redeem-by date stated in the offer or given with the gift. Once activated, a time-limited gift continues for its advertised access period.

A promotion’s closing date determines when the qualifying purchase must be made. It does not shorten the redemption period of a gift already issued.

Renewals and subsequent purchases do not include another Promotional Gift unless expressly advertised.

Only one offer or promotion code can be applied to a purchase. We may end or change an offer early; gifts and prepaid months already issued are not affected. If a purchase does not meet an offer’s conditions when payment completes, we may decline it and refund the payment in full.

8. Passing a gift to another person

Before redemption, a gift may be passed to another eligible recipient, subject to any product-specific restriction clearly disclosed before purchase.

If the gift is addressed to a named person who cannot accept it, contact us to arrange reassignment. We may cancel the original code and issue a replacement.

After activation, access is normally linked to the recipient’s account. Contact us about mistaken activation or another reason a transfer is needed.

Event-ticket and appointment transfers are subject to the rules disclosed for that offering and applicable law.

9. Cancellation and refunds

Your legal rights come first. The policy below is additional to statutory withdrawal, cancellation, return, refund and consumer-guarantee rights. A shorter period or restriction in this policy does not override a more favorable legal right.

Unredeemed gifts. The purchaser may cancel within 30 days after purchase for a refund of the amount paid for the unused gift.

Subscriptions, courses and digital products. The purchaser may cancel within 30 days after purchase, even if the recipient has activated the gift. We will refund the amount paid and cancel the remaining access. We do not treat activation alone as a waiver of statutory withdrawal rights.

After that period, we do not ordinarily provide change-of-mind refunds for activated digital gifts. Rights arising from defects, nondelivery, misdescription or applicable law remain unaffected.

Dated events and scheduled services. Any exception to our voluntary change-of-mind policy must be clearly disclosed before purchase. Statutory rights remain unaffected.

How to cancel. Contact [email protected] or send a clear cancellation statement to our business address. We may request information reasonably necessary to locate the purchase; we will not require an explanation for exercising a no-reason cancellation right.

How refunds are paid. Refunds normally go to the original payment method, without a refund fee. We will process them without undue delay and within the legally required period.

For a refund of one item in a larger order, we refund the amount paid for that item, including applicable tax and its allocated share of discounts. Other purchases remain unchanged.

An approved refund cancels the affected unredeemed gift and any scheduled delivery. For a redeemed subscription gift, a refund takes back gifted months not yet used. Months already used are not recovered, and the recipient is not charged for them.

10. Refunds involving Promotional Gifts

If the qualifying purchase is fully refunded or validly canceled, the associated Promotional Gift may also be canceled, to the extent permitted by law. This includes any prepaid months issued with it that have not yet been used.

For an activated subscription or digital-service gift, cancellation ends the remaining promotional access.

Canceling future renewal or receiving a partial refund does not, by itself, cancel the Promotional Gift.

We will not deduct the advertised retail value of a Promotional Gift from a refund otherwise due.

A Promotional Gift has no separately paid purchase price, but its promotional status does not remove any consumer rights or remedies that apply to it.

11. Lost gifts, payment disputes and fraud

Contact us promptly if a gift or code is lost, stolen or used without permission. Where we can verify the purchase and identify the unused entitlement, we will help recover it or provide a replacement.

A payment dispute does not automatically cancel an activated gift. We may investigate and request relevant information.

Where there is reasonable evidence of fraud or unauthorized use, we may temporarily restrict the affected gift while investigating. Any restriction will be proportionate, and we will provide notice where reasonably practicable.

If payment is finally reversed or confirmed to be unauthorized, we may cancel the affected gift or remaining access to the extent permitted by law. We will not cancel unrelated purchases or restrict lawful payment-dispute rights.

12. Consumer protections and international purchases

Your statutory rights. These terms do not exclude or limit any mandatory rights under applicable consumer law, including rights relating to cancellation, withdrawal, refunds, and products or services that are defective, unavailable or not as described. If these terms conflict with a mandatory legal requirement, that requirement applies.

European Economic Area and United Kingdom. Where statutory distance-selling withdrawal rights apply, you may withdraw within the applicable period—generally 14 days from contract formation for services or digital content, or from delivery to the recipient for goods. Longer periods apply where the law requires them. Our voluntary refund policy may provide additional time.

We do not rely on activation alone to remove withdrawal rights. We do not ask you to give up your withdrawal right when access begins, so you keep it for the full withdrawal period even if the recipient has already started using the gift.

Australia. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to the remedies available under that law, including repair, replacement, refund, cancellation or compensation where applicable.

Other countries and U.S. states. Any mandatory local rights continue to apply, including cancellation periods and remedies for defective or unavailable products.

Nothing in our general terms requires you to give up a court, complaint procedure, governing-law protection or other remedy that applicable law makes available and does not permit us to exclude.

13. Changes and complaints

The gifting terms supplied at purchase govern that gift. We will not retroactively shorten its redemption period, reduce its promised value or access period, or remove an accrued refund right.

Changes required by law or agreed with you will be handled consistently with applicable consumer protections.

For questions or complaints, contact [email protected]. This does not prevent you from contacting a consumer authority or using an applicable dispute-resolution process.

14. Unavailable or discontinued offerings

If a product or service specified in an unredeemed gift is no longer available, please contact us. We will offer a reasonably comparable replacement at no additional charge, subject to the recipient’s agreement. Any replacement subscription will provide at least the access duration originally promised.

(a) For a Paid Gift, if no acceptable replacement is available, we will refund the amount paid for the unavailable gift to the purchaser, normally using the original payment method. This refund is not limited by our change-of-mind refund period.

(b) For a Promotional Gift, we will offer a comparable replacement. If no acceptable replacement is available, we will provide any cancellation, refund or other remedy required by applicable law in connection with the qualifying purchase.

(c) Nothing in this section limits mandatory consumer rights.

15. Dispute resolution

The dispute-resolution provisions in Section 16 of our Terms of Service are incorporated into these Gifting Terms and apply to disputes concerning the purchase, issuance, redemption or use of gifts, including Promotional Gifts. Any exceptions, opt-out rights and procedures in that section also apply. Nothing in these Gifting Terms limits mandatory consumer rights concerning applicable law, courts or dispute resolution.
